HI All
I am worried about my employer. Given the fact about I-485 apps and the last few days of labor in the previous month I have doubts about my employer. He is a very mean and hopeless desi employer and I am worried if he sold out my labor to some high bidder. is there any way i can find out if my labor is still infact in my name. any thoughts

Hi:
If you are unmarried, then you GC parents can file an 1-130 petition for you right now. Once tthebecome a citizen, you can change the category F-1, and retain the priority date.

My contract pre-maturly ended on Sep 27, 2008. I was on hourly rate on W2. So far I haven't find any assignment. I don't get paid.
Am I eligible for unemployment benefits. Has anyone claimed this. Are there any future disadvantages if you show unemployment.
Please let me know

I am not sure about contracting positions, but if you were a full-time employee of a company and are laid-off, then you are eligible to claim unemployment benefits, which is true for GC holders, too.

Please share your experience, if any one come across this situation
I think you can us AP. I did not go for stamping but based on my I-485 filing I know that my case is pending on name check and I came to US using AP so I think you can also come back using AP.

Here is my suggestion:
Apply for H-4 as this should be straight-forward and fly your wife the US in March. Prepare H-1 papers and get it ready to reach USCIS on April 1st.
If H-1 is acceped in lottery(assuming there is going to be one), then H-1 status starts from October 1st. For travel purpose your wife will have to get H-1 stamping (which can happen only after October 1st).
Hope this helps.

My employer is not ready to give a copy of I-140. I was wondering if any of you used "The Freedom of Information Act (FOIA)" to get it.
So far I found that there are 3 things to be done for FOIA :
1. A request letter mentioning what exactly you are asking for.
2. Notarized copy of Form DOJ-361 (Certification of Identity)
3. Fee
Wanted to know, if any of you actually did this and get a copy of I-140 back. What is the fee ? How did you pay it ? Was there any other document that you sent ? Am I missing anything ? Who did you send the request to ?

Hi Experts,
My 140 was recently transferred from Nebraska to Texas after waiting 13 months. RD is March 2007. My company's lawyer contacted USCIS to open an SR as Texas is processing July/Aug 2007 applications and past my processing dates. USCIS refused to open an SR and advised that my application will be treated a new one and will be processed after the other application received in April 2008.
I think USCIS should honor the original RD when a case is transferred from one service center to the other.
I am shocked. I have already waited for 13 months and don't feel this is fair.
I am not sure what are my options are now? I am thinking to contact Ombudsman and local congress man.
Please advice.

1. Personal check or Money order for 380$. I prefer sending personal check so that i can know if my check was cashed.
2. I did paper filing and not e-Filing. Some say efile is better some say paper filing is better , i felt paper filing is easy and better , as we can track our documents sent.
3. Docs req are

2. your 485 receipt notice copy
3. Current Addresss proof. electricity bill, water bill etc.
3.Copy of the biographic page of passport for each applicant
4. i-94 Copy
5. 2 Photographs

Hi, there is nothin' to be confused about. There are many many student here who cant speak English well, in fact, most of my spanish/latinos/germans friends have issues taking classes here but they manage so why cant my friend !! Her spoken English is fair but when it comes to writing she really has to work hard on it..anyways, as for her Aunt:
-The affidavit that her aunt signed along with her bank stmts attached had two parts. The first one only asked the sponsor to check whether he/she will fully support or partially and the second part said, 'if you're a US citizen fill out the part below' and my friend's aunt DID NOT fill that part out or claimed to be a US citizen. She also knows that she is illegal here and she cannot LIE about being legal.

My wife had returned from India on Dec 2nd 2004 and her H4 stamp was valid till Jan 26th 2005 - Less than 2 months validity. She did not face any problem reentering. Infact we filed our extentions after she came back.

I am in my 9th year and have applied for extension (3 yr, based on approved I-140).
Now if my wife were to go to India and in a couple of months apply for her

My H1B 6 yr limit is set to expire in July 2008. I have an EAD/AP from filing in July. I want to invoke AC21 and change jobs using EAD. I hear a lot of people mention about keeping your H1B visa just in case the I-485 application gets rejected. But even if I extend my H1, it will be based on the fact that I have applied for I-485 since I am over the 6 yr limit. In that case, won't my H1 extension be void too if the I-485 gets rejected. I am not really sure how maintaining H1B/EAD together helps people in my situation. ANy thoughts/inputs welcome.

You extend you H-1B (< 6yrs) based on approved PERM and/or approved I-140. So if your I-485 was rejected, your H-1B would be safe. However, if your employee or USCIS revoked the approved PERM/I-140, then I don't know what would happen to the extended H-1B.
If you invoked EAD and USCIS rejected your I-485, you would lose the EAD as well as the I-485 pending status because EAD was granted on your pending I-485 status.

My attorney has asked for the I-485 to be printed:
double sided with Flip to Top option.
Did anyone else do the same?
for what its worth I printed mine single sided. I hope USCIS is not as nitpicky as your lawyer. I printed in black ink, maybe if it was pink or green or orange they might raise an eyebrow, otherwise I hope they dont really care
