If your spouse takes a student loan in USA, there are other advantages though. He/she can claim student loan deduction on the taxes !! Not sure your Indian bank would provide the necessary forms to you or if they have a legal obligation to submit anything to IRS here.

I have a question. Why is it that no one, including AILA, considered filing a lawsuit asking USCIS to do their jobs.
In this world of retrogression and uncertainity, USCIS is processing very slowly. If they can use all 140,000 visa numbers and the recaputre numbers from 1999-2000 (I think it is around 220,000), we might not have this problem here today.
We are not asking them to make any changes to law or administrative fixes. All we are asking is that they do their jobs efficiently. So, why is it no organization has tried this? or has this been tried before and failed..

Have another question regarding AP, we have filed 485 in jul 07, we got Recept for AP, but no other updated on AP, in case of Emargency can we go to the local office to get AP, is there any Rule that poeple applied AP for the first time will not get the same from local office.

Hi,
I just found out that my employer did not update the work location on my LCA. I have been working in new jersey for over 4 years now. I have my primary address as Indiana and my company is registered in Illinois. I got payroll on Illinois for 2 years and now NJ for 1 year.
How can i correct this? Is it too bad a problem already?

One can have more than one H1B at a time. So you can ask the second company file for transfer too. If you worry about the first petition, and you feel comfortable to do so, talk about it with the attorney of the second company. Or, you can call USCIS and ask a immigration officer.
I joined a new employer in May and also had applied for H1B transfer at that time. Now I have a very good offer from another firm but my first H1B transfer is still pending. The new offer is much more rewarding financially. Is it possible to apply for H1 B transfer to the new employer without jeopardizing my H1B status. Please note that I got laid off in April and I was in a hurry to get the new job then, it was also about just over a month when I applied for my H1B transfer since losing that job so I am kind of nervous about the results from USCIS.

if H1 denied by current company and still he has time with wariler I797, in this case sep09, can he try apply H1 transfer to some other company ?

Hi Gurus,
My wife has her H4 Visa stamp until 1st Oct 2010. She is in India. I am planning to visit India and travel back with her. If my visa gets stuck in "Admin Processing" will my wife be able to travel back on her valid H4 Visa.
She has to travel back due to some personal reasons.
Please advise.

yes, She will be able to return back as long as you both dont go for stamping together. If you get stuck in Admin Processing then they will cancel her current visa until you get your visa since she is dependent on you.
So the best thing to do is, you go for stamping first and if it works out for you then let her go for stamping afterwards or She can enter using her current visa and then file an extension before it expires.

There shouldn't be any issues. The H1 visa stamp on your passport is seperate from the I-797 approval that you received, both are valid. Your wife should also have no problems getting an H4 using your current I-797. I had a freind recently who was in the exact same situation and he and his wife both didn't have any issues.

Well I'm not sure about datalists but assuming you have edited the object in memory the binding should reflect the edits. If not I usually just write a Requery method which queries the data source again and rebinds the offending control
You might want to have a look at CSLA - it's a library for maniuplation of business objects supporting parent/child collection heirarchies, error providing, multiple undo levels etc etc - it certainly speeds up creating a business app around here. We usually combine it with CSLAGen which is a template generator based on CodeSmith which generates CSLA objects for you from a database schema - all you need to do is write the sprocs which get/update/delete the data and then it does the rest (you might tweak it a little here and there).
It's got a bit of a learning curve but once you know what you are doing it's invaluable! That would solve your refresh issues :)

I have applied AP for my family 3 weeks before. My wife needs to go India by end of next month. If AP approval doesn't come to our hand by next month, can she leave the country? If she shouldn't, what are the alternate options? I appreciate your help.
If she needs the AP to return to the US, then she cannot leave until she has that AP in her hand. However, she may be able to return in H or L status IF she has been maintaining that status . If she is in a dependent status (H-4 or L-2), she can use that to return if you are maintaining the principal H-1B or L-1 status and if she has not worked.

Yes you can as far as I remmember. You can transfer on the the reciept of the notice date of the already filed H1B.
I always suggest, please Discuss this with a lawyer...and the lawyer is the best person to help you out.
